TWOCRUSH SHIPPING POLICY
1. OBJECT AND SCOPE OF APPLICATION
These General Terms and Conditions of Sale regulate the purchase of products through the website www.twocrush.com (hereinafter, the “Website”), owned by Ecopartners Granada SL, as well as the rights and obligations of the parties arising from said operations.
By placing an order on the Website, the user (hereinafter, the “Customer”) declares to be of legal age, to have the legal capacity to contract and to accept without reservation these General Terms and Conditions of Sale, together with the Legal Notice, the Privacy Policy, the Shipping Policy and the Exchange and Returns Policy.
2. SELLER IDENTITY
Sales made through the Website are understood to be made by:
Ecopartners Granada SL
Registered office: Camino de Ronda, 210, ground floor commercial, 18003, Granada, Spain
CIF: B24906554
Contact email: info@twocrush.com
The trade name used is TWOCRUSH. For the purposes of these General Terms and Conditions of Sale, references to “TWOCRUSH”, “we” or “the Seller” shall be understood to refer to Ecopartners Granada SL
3. NATURE OF THE PRODUCTS AND CONDITION OF THE GARMENTS
TWOCRUSH mainly offers pre-loved and vintage clothing and accessories, from different brands, eras and collections.
The Client should be aware that:
These are not new products directly from the manufacturer, unless expressly stated otherwise.
The garments may show slight signs of use, typical of their age or origin, which do not affect their normal use and which, as far as possible, are described in the product sheet.
TWOCRUSH performs a selection, inspection, and conditioning process on each piece, but cannot guarantee that the condition will be comparable to that of a brand new product.
In any case, the product sheet will indicate the essential characteristics of each garment, its general condition and any relevant particularity, so that the Customer can make an informed purchase decision.
4. PRODUCT AND PRICE INFORMATION
The main characteristics of the products (description, materials, condition, size, photographs, etc.) are shown on the corresponding page within the Website. TWOCRUSH makes reasonable efforts to ensure that the information is as accurate as possible; however, images and colors may vary slightly depending on lighting conditions, the screen used by the Customer, and other technical factors.
Product prices are shown in euros and include all applicable taxes unless otherwise stated. Shipping costs and any other surcharges or additional costs will be itemized during the checkout process before order confirmation.
TWOCRUSH reserves the right to modify, at any time, the prices and product offerings displayed on the Website. Modifications will not affect orders already confirmed.
5. PRODUCT AVAILABILITY
Given the unique and limited nature of many of the garments offered by TWOCRUSH, product availability is sometimes very limited. The fact that a product appears on the Website does not necessarily mean that it is in stock at all times.
In the event that, due to circumstances beyond the Seller's control, a product is unavailable after the order has been confirmed, TWOCRUSH will inform the Customer as soon as possible and will proceed, as appropriate, to:
Offer a reasonable alternative, if one exists.
Fully refund the amounts paid for the unavailable product, without any further compensation.
6. PURCHASE PROCESS AND CONTRACT FORMALIZATION
To place an order, the Customer must follow the steps indicated on the Website, select the desired products and complete the information requested during the checkout process.
Before finalizing the order, the Customer can review the purchase summary, including selected products, quantities, prices, applicable taxes, shipping costs and payment method.
The sales contract will be considered perfected when the Customer confirms the order and TWOCRUSH sends a confirmation email accepting the purchase and detailing the essential data of the operation.
TWOCRUSH reserves the right to refuse orders in the following cases, among others:
When there are reasonable doubts about the veracity of the data provided.
When possible fraudulent or unauthorized uses of payment methods are detected.
When the product is unavailable or there have been clear errors in the price or description.
7. PAYMENT METHODS
The accepted payment methods are listed on the "Payment Options" page and during the checkout process. The customer must select one of the available methods and provide the corresponding information.
The charge will be processed in the currency and amounts shown at the time of order confirmation. The use of each payment method may be subject to the terms and conditions of the external provider that manages it (bank, payment gateway, digital wallet, etc.).
The Customer agrees to use only payment methods to which they are the legitimate owner. TWOCRUSH will not assume any responsibility in the event of unauthorized use of payment methods by the Customer or third parties, without prejudice to any rights the consumer may have against their financial institution.
8. SHIPPING, TIMES AND DELIVERY
The conditions relating to available destinations, estimated delivery times, delivery costs and other logistical matters are detailed in the Website's Shipping Policy.
In general:
The order will be considered delivered when the carrier makes it available to the Customer at the indicated address or at the agreed collection point.
It is the Customer's responsibility to verify the accuracy of the shipping address and the accessibility of the delivery location.
If any visible damage to the packaging or other issues are noticed upon delivery, the Customer is advised to report this to the carrier and notify TWOCRUSH as soon as possible.
The risk of loss or damage to the product is transferred to the Customer at the time of actual delivery.
9. RIGHT OF WITHDRAWAL, EXCHANGES AND RETURNS
Customers who qualify as consumers have the right to withdraw from the contract under the terms provided by the applicable regulations on consumers and users, except for the legally provided exceptions.
The specific conditions relating to the exercise of the right of withdrawal, the deadlines, the method of returning the products, the associated costs and the particularities derived from the pre-loved nature of the garments are included in the TWOCRUSH Exchange and Return Policy, which forms an integral part of these General Terms and Conditions of Sale.
Before making a return, the Customer must review this policy and follow the procedure described therein.
10. DEFECTIVE OR NON-CONFORMING PRODUCTS
If the Customer receives a clearly defective product or one that does not correspond to the order placed, they must notify TWOCRUSH within a reasonable time after receipt, preferably providing photographs and a detailed description of the issue.
Given the pre-loved and vintage nature of the garments, minor imperfections, signs of use, or marks typical of the age and origin of the piece that have already been reasonably described in the product sheet or that are compatible with its general condition will not be considered defects.
Once a relevant defect or a lack of conformity not attributable to the inherent condition of the part has been verified, TWOCRUSH may offer the Customer, depending on the circumstances:
Reasonable repair of the garment, where feasible.
A full or partial refund of the price paid.
The specific solution will be determined on a case-by-case basis, taking into account the uniqueness of each piece and the availability of alternatives.
11. LIABILITY AND LIMITATIONS
TWOCRUSH does not guarantee uninterrupted availability of the Website or the absence of technical errors, although it undertakes to take reasonable measures for its proper operation.
Unless otherwise provided by law, TWOCRUSH's liability to the Customer for any matter related to the purchase of products through the Website shall be limited, at most, to the total amount paid by the Customer for the corresponding products.
Under no circumstances will TWOCRUSH be liable for loss of profits, indirect damages, losses arising from improper use of the garments or breaches attributable to the Customer or third parties unrelated to the Seller (including transport companies, payment platforms or external service providers).
12. MODIFICATION OF THE TERMS AND APPLICABLE LAW
TWOCRUSH reserves the right to modify these General Terms and Conditions of Sale at any time and without prior notice. Modifications will not affect sales contracts already in place, which will be governed by the version in effect at the time of order confirmation.
These General Terms and Conditions of Sale shall be governed by and construed in accordance with Spanish law, without prejudice to the application of mandatory consumer protection regulations that may be applicable in each case.
For the resolution of any potential disputes, the Courts and Tribunals that correspond in accordance with current regulations will have jurisdiction, respecting, where appropriate, the rights of the Client in their capacity as a consumer.
